Why Us
The court can change support only back to the day the request was filed. We prepare your modification forms from the details you give us, so you can review them and decide when to file.
Questions
The court says a judge can change child support only back to the day the papers asking for the change were filed. Its example: a job lost March 1 with papers filed July 1 means the change starts July 1. That is why the filing date matters.
Form FL-390, Notice of Motion and Motion for Simplified Modification of Order for Child, Spousal, or Family Support. It tells the other party about a hearing to change a support order and explains which other forms are needed and how to serve them.
A current Income and Expense Declaration, form FL-150, is commonly needed with a support request. We organize the figures you give us. The court's information sheet for requests for order lists which forms may be needed in your situation.
The papers must be served by someone 18 or older who is not part of the case. For a post-judgment request to change support, the court says mail service is allowed only if there are no emergency orders, no court order for personal service, and a verified address.
The court says the agency must approve an agreement to change support in agency cases. Check with the local child support agency to see whether it is in your case. We prepare the forms you direct and cannot advise on the agency's role.
