Questions

Frequently Asked Questions

The California Courts say assets in a living trust should go to the beneficiaries without probate court, but only as long as you have put your assets into the trust. A trust that is signed but never funded may not do that. Write Legal prepares documents and does not promise any outcome.

A living trust is a written document signed by the person who made it. For California real estate, the law accepts a trust shown by a signed writing or by a deed putting the property into it. Many people also sign a pour-over will. We prepare the documents you direct us to prepare.

The law says a revocable trust can be revoked by the method the trust states, or by a signed writing delivered to the trustee. Unless the trust says otherwise, the person who made the trust can modify it by the same method.

A will that leaves property to a trust. The law says the gift is valid if the will identifies the trust and the trust is in a signed written instrument. The original will must go to the court clerk within 30 days after the holder learns of the death.

The California Courts say living trusts are complicated and you usually need a lawyer's help. Write Legal is not a law firm and cannot give legal advice. We prepare documents at your specific direction, and you decide whether to get an attorney's advice.
