Questions
Form DE-221, Spousal or Domestic Partner Property Petition, asks the court to find that property passes to the surviving spouse or partner without administration, or belongs to them. We prepare it from the details you provide.
It is a separate petition. Whether it applies to your property is a legal question we cannot answer. We prepare what you direct, and the court decides the petition at a hearing.
The law says that 40 days after a spouse's death, the survivor may sell or dispose of real property the couple owned together, and may record an affidavit stating the facts that give that right. We prepare the documents you direct.
Joint tenancy has its own procedure. Community property with right of survivorship, in deeds on or after July 1, 2001, passes to the surviving spouse without administration using the same procedures as joint tenancy. We can prepare an affidavit of death if you direct us to.
No, we do not determine which procedure a person qualifies for or recommend legal strategies. You decide which petition to prepare, and the court makes the final decision.
