Why Us
A retirement division order puts the terms of your judgment in the form a plan expects. We type the terms you give us into the order. The plan administrator, not Write Legal, decides whether an order is accepted.
Questions
A qualified domestic relations order gives a former spouse, called the alternate payee, a right to part of a retirement plan benefit. The plan administrator decides whether the order meets the plan's requirements, and an order is qualified only once the plan accepts it.
No, we do not determine retirement benefits, draft legal strategies, or guarantee that a plan administrator will approve an order. The division comes from your judgment or agreement, and we type those terms into the order paperwork.
They have their own rules. CalPERS says its benefits are community property in California and publishes sample domestic relations orders. Each plan sets its own requirements for an acceptable order.
CalPERS says a dissolution can revoke a beneficiary designation filed before the dissolution began. Rules differ by plan, so check with your plan about what a judgment changes. We cannot give legal advice about your plan.
That depends on the plan and your agreement. Many plans offer an optional review of a draft order before it is filed. We prepare the document at your direction, and you decide how to submit it. Check with the plan administrator for its process.
