Questions

Frequently Asked Questions

After the person who made a revocable trust dies and it becomes irrevocable, the law says the trustee must serve a notice on every beneficiary and every heir of the person who made the trust within 60 days. The notice must contain specific information and a warning about the time to contest the trust.

The law says a person served has 120 days from service to contest the trust, or 60 days from delivery of a copy of the trust terms during that period, whichever is later. We prepare the notice you direct and cannot advise on contests.

The law says that once the person who made a revocable trust dies and it becomes irrevocable, any beneficiary or heir who asks must be given a true and complete copy of the trust terms. The notice tells recipients they can ask.

The law says a person named as trustee accepts by signing the trust or a separate written acceptance, or by knowingly using the trustee's powers. We prepare an acceptance at your direction and cannot advise whether to accept.

Yes, in the ways the law lists: as the trust allows, with the consent of the person holding the power to revoke, with the consent of adult beneficiaries, or by court order. Resigning does not release a trustee from liability for earlier acts. We prepare the document you direct.
